The processes of transnational justice have not yet come near to attaining the level of expectations associated with the rule of law, where equals are treated equally. Hence, it is an imperfect justice, with the strong treated differently than the weak, but still arguably an advance over widespread circumstances of "immunity" and "impunity."

It remains uncertain whether most leading states will decide to become parties to the International Criminal Court now that it is established. Past efforts to include terrorism among indictable international crimes by an international tribunal have foundered due to a lack of consensus as to whether "terrorism" should be defined to include violence by states against civilians, as to how nationalist and self-determination struggles should be treated, and whether capital punishment should be imposed. Such obstacles do not exist at a national level where states generally legislate their own self-serving definitions of terrorism.
